Nomination of a Transnationalist for the State Department’s legal Adviser

Harold Koh was nominated this past week by President Obama. Koh describes himself as a “transnationalist”. So… what is a transnationalist?

  • emphasize the interdependence between the US and the rest of the world
  • believes in and promotes the blending of internation and domestic law
  • views domestic courts as having a critical role in domesticating international law into US law
  • believes that US courts should limit their attention to the development of a national system.
  • believes that US courts can and should use their interpretive powers to promote the development of a global legal system
  • Still don’t quite get it? Ed Whelan explains:

What judicial transnationalism is really all about is depriving American citizens of their powers of representative government by selectively imposing on them the favored policies of Europe’s leftist elites.

    What is a Faustian?
and why is Obama’s name being used in the same sentence? I have to admit I’m not as culturally literate as I’d like to be so I had to look up what a Faustian is:

Faust or Faustus (Latin for “auspicious” or “lucky”) is the protagonist of a classic German legend who makes a pact with the Devil in exchange for knowledge. Wikipedia

What’s the difference between a 2003 Road Map and a 2008 Annapolis Conference?
Start with 3 phases, phase 1 being most important (Road Map). Subtract 2 phases, phase 1 and 2, leaving only phase 3 (Annapolis Conference). Let me break it down for you just a little more so you’ll really understand. The Road Map agreement in 2003 consisted (I should say that in present terms considering this is the agreement that the current Israeli government is following) has the following phases. Note: The order of the phases is very important!
  • 1. permanent end to Palestinian terrorism and to anti-Israel incitement, and for Israel to freeze settlement activity and remove illegal outposts in the West Bank.
  • 2. envisages strenghening Palestinian institutions and establishment of temporary borders for an eventual Palestinian state.
  • 3. parties are called on to negotiate final-status issues, including permanent borders, refugees and Jerusalem.
  • The Annapolis Conference was held in 2007 and was an attempt by Bush and Rice for a Middle East Peace legacy before they left office:

  • 1. immediate final status talks. Note: Israel was under continued rocket attacks from Hamas-ruled Gaza and Palestinian Authority under Mahmoud Abbas.
  • Israel’s new government of Netanyahu-Lieberman are giving notice that Israel is prepared to move toward a two-state solution contingent on and end to terrorism. Lieberman, FM of Israel said, “That means that terrorism would have to stop before the Palestinians get their state.”

BTW - Turns out there was some embarrassment for the UNRWA Employees. Remember all that money that Hillary gave to help rebuild Gaza by way of the UNRWA? There was some serious concern that this money would end up in that hands of Hamas. Well, UNRWA teachers elected *only* Hamas-affiliated representatives! Did He Really Apologize for America?
Obama’s speech in Strasbourg went further than any United States president in history in criticising his own country’s action while standing on foreign soil. He apologized for American action that liberated Iraq from the genocidal tyrant Saddam Hussein. Note: yet Iraqis were able to walk to polling stations to vote in their first democratic elections in 2005 and again this year, 2009 (My son was there to help!!)

Gee Whiz! They shot off that rocket after I told them not too!
Reuters quotes diplomatic sources as saying that UN Security Council is unlikely to impose any sanctions on North Korea for firing a missile in defiance of earlier Security Council Resolutions.

Newt Gingrich says, “too many people do not appreciate the scale of the threat that is evolving on the planet.”
